Why do I need Independent Legal advice for my Skipton Mortgage?

Skipton Building Society will require an Independent Legal advice certificate to be signed by a solicitor in the following circumstances:

  1. The legal owner is different to the those taking on the responsibility for the mortgage.
  2. The money is lent to a company
  3. You are the guarantor
  4. You are parents lending to your child/children

Such a step is usually time-sensitive and could jeopardise the transaction if not completed in a timely fashion. This is often the final piece of the jigsaw in a long and laborious process.  Your own conveyancing solicitor will be unable to offer this service as the mortgage company requires another independent solicitor to advise on the transaction.  This is where we come in.

We are there for when you might need another solicitor standing by to deal with the final part of the transaction.

We have a fixed fee advisory service and we do not require you to come to the office.

What are the steps?

You will receive the mortgage offer and mortgage deed from your solicitors. There should also be an Acknowledgement and a Certificate that we  will need to sign.

The solicitor will review the documents and arrange a video conference  by Zoom. You will need to produce ID before the videoconference (scanned and sent by email) and also at the time of the videoconference. The meeting will usually be recorded.

You will also be asked to sign the acknowledgement in front of the solicitor during the videoconference.

The solicitor during the videoconference (which will take between 30 and 40 minutes) will ask various questions about the transaction and the guarantors background and give legal advice. The solicitor will then confirm the advice in writing.

You will then need to pay the fees and send the original signed Acknowledgement by email and recorded/registered post to us.

Once this has been received by the solicitor, they will sign the acknowledgement confirming they have witnessed the signature remotely. There is a unique endorsement which is written on the Acknowledgement which confirms how the remote signing was undertaken.

The Acknowledgement and certificate will then be sent to Skipton by recorded delivery or to your nominated solicitor (who may wish to send this to Skipton themselves).
