Why do I need Independent Legal advice for my Lendinvest Mortgage?

LendInvest will require an Independent Legal advice certificate to be signed by a solicitor in the following circumstances:

  • The legal owner is different to the those taking on the responsibility for the mortgage.
  • The money is lent to a company
  • You are guarantor
  • You are parents lending to you child/children

Such a step is usually time-sensitive and could jeopardise the transaction if not completed in a timely fashion. This is often the final piece of the jigsaw in a long and laborious process.  Your own conveyancing solicitor will be unable to offer this service as the mortgage company requires another independent solicitor to advise on the transaction.  This is where we come in.

We are there for when you might need another solicitor standing by to deal with the final part of the transaction. We have a fixed fee advisory service and we do not require you to come to the office.

What are the steps?

  1. Undertaking
    We will need to give an undertaking on costs. This means we the solicitors promise to pay the legal costs of LendInvest. This is usually about £300 plus VAT but can be considerably more depending on the nature of the transaction.
  2. The Pack
    You will receive a pack from your conveyancing solicitors which will include:
    – Guarantee and Indemnity agreement
    – Independent legal advice confirmation
    – Mortgage offer
  3. Send the original ID to us
    You will need to send your original ID by recorded delivery and we shall send this back by the same method. We shall take a photocopy of the ID and return this to you. What you need to send us:
    – Passport or Driving License
    – Bank statement no more than 3 month old or Council tax bill not more than 3 months old – please note print outs may not be acceptable.
  4. Get a witness ready
    You will need send us the ID of your witness who will witness you sign the Guarantee and Indemnity. We will need to see them witness your signature on the Guarantee and Indemnity
  5. Meeting via Videoconference
    The meeting will be by Zoom and we shall advise you on the documents. If there are two directors then we shall speak to you individually. Once we have advised you, you will need to ask your witness to come and witness the document. We shall guide you through the process.
  6. Sending out the ILA certificate
    Once the advice is given the certificate is sent to your solicitors by recorded delivery and by email . We shall write to you with confirmation of advice and a copy of the certificate. We provide efficient service with the minimum of fuss.
Please note your name should be the same on all documents if it is not it may delay matters.

How long does it take?

The lead in time would be about one week as we need to wait for the pack and give the undertakings. You need to set up the witness and then arrange the meeting and send out the certificate. The delays would be receiving the pack and liaising with the lawyer for LendInvest.

For any additional person, we need to advise (in joint lending/guarantors)
